North Miami Seashore man fights to clear title after practically 17 years behind bars – NBC 6 South Florida

In the summer of 2006, 19-year-old Emmanuel Jean was just days away from starting a new chapter of his life. A standout football player at Bay Point School, he had earned a full scholarship to play college ball in California.

But his future came to a halt when he was arrested and later convicted of murder.

Jean was accused in the fatal shooting of 60-year-old Mohammad Ayoub, a convenience store owner and father, during an attempted robbery in North Miami Beach.

Miami-Dade County prosecutors claimed Jean was one of three teens involved in the crime. He was eventually convicted of first-degree murder and sentenced to life in prison.

But in 2023, a Miami-Dade judge threw out his murder conviction after new evidence raised questions about the reliability of key testimony used to convict him. As part of a negotiated agreement with the Miami-Dade State Attorney’s Office, Jean pleaded guilty to a less serious charge, conspiracy to commit robbery—and was released 17 years later.

Jean grew up in North Miami Beach as a part of an immigrant Haitian family. He says times were often tough and sometimes he was mixed in with the wrong crowd. As a teenager, Emmanuel says he was arrested for a drug charge and referred to a special rehabilitation school—then called Bay Point. There, he met volunteer teacher and attorney Joseph Klock, Jr., who took an interest in his future.

Joseph Klock told NBC6: “He was in one of my classes. I got close to him and his family.”

Klock says he eventually helped Jean secure a college scholarship to play football in Santa Clarita, California.

But just two days before his scheduled departure, Jean was arrested and charged in Ayoub’s murder.

Klock, who stayed in contact with Jean’s family over the years, said he always believed in his innocence. He says the state’s case hinged largely on witness testimony, noting there was no gun recovered and no DNA evidence.

Prosecutors moved forward with the case against Jean, arguing he was there that night with another 19-year-old and a 16-year-old, who was described as the getaway driver. That 16-year-old did not witness the crime, but he testified against Jean, according to court filings 

At the time, both co-defendants pleaded guilty to second-degree murder and served less than a decade in prison.

Another witness claimed to have identified Jean from a photo lineup and in court, according to court records. Years later, that witness would play a key role in securing his freedom.

NBC6 reached out to Ayoub’s family. They believe Jean is guilty and the judge made a mistake by reversing his murder conviction, adding they were never consulted or asked to provide a statement about the impact of this decision.

“It is shocking and horrible what he (Jean) did and continues to perpetuate on the residents of South Miami. He is a menace. He belongs behind bars for life. Full stop,” they said.
