Fla. Decide Axes EB-5 Swimsuit Over Miami Seaside Venture
By Alyssa Aquino (March 8, 2022, 3:03 PM EST) — A Florida judge permanently shelved claims that the developers of a Miami Beach hotel defrauded foreign investors out of millions and cost them their chance to immigrate to the US, saying the lawsuit was faulty despite two chances to fix it.
On the recommendation of US Magistrate Judge Alicia Otazo-Reyes, US District Judge Darrin Gayles dismissed with prejudice eight investors’ claims against more than a dozen individuals and companies tied to the Greystone Hotel project. The allegations didn’t contain enough details to survive, Judge Gayles said, agreeing with Judge Otazo-Reyes’ assessment.
