A man accused of fatally shot and killed a tourist over dinner with his family at a Miami Beach restaurant while the man was protecting his one-year-old son was formally charged Tuesday morning.

Tamarius Blair Davis, 22, faced second degree murder and attempted second degree murder in the August 24 shootings.

Davis did not appear in court, but his attorney pleaded not guilty on his behalf.

Davis, of Norcross, Georgia, told investigators he shot 21-year-old Dustin Wakefield because he was “high in mushrooms, which made him feel empowered,” according to his arrest report.

Davis fled the restaurant, reported the police, and was arrested in a nearby alley.
